Train MBS Terms and Conditions

You are advised to read (and are responsible for reading) all information set out in these terms and conditions fully. The purchase of any training package, service, or product from Train Mind Body Soul Limited, or our Personal Training Team, is deemed as acceptance of these Terms & Conditions.

Train Mind Body Soul is a wellbeing studio which delivers in person training and wellbeing services, along with live, and on-demand workouts, delivered by some of Glasgow’s most inspirational and experienced trainers.

By using our services, you are also agreeing: (i) that you have read and understood our Privacy Policy which sets out how we collect, process and use your information; (ii) to our Terms and Conditions. Please read these Terms carefully before you start to use our Services. We recommend that you print a copy of these Terms for future reference. If you do not agree to these Terms, you must not use our services. Finally, that you have read and understood (iii) Our Informed Consent policies.

By entering this website or purchasing or using our blog, e-mails, programs, services, and/or products, you are agreeing to accept all parts of these terms. Thus, if you do not agree to the terms below, STOP now, and do not use our website, blog, e-mails, programs, services, or products.

By using this website, blog, e-mails, or any of our programs, services, or products, you implicitly signify your agreement to all parts of the above [or below] disclaimer.

1. Personal Training General Terms

- Your Personal Training Sessions are generally carried out on mutually agreed, consistent days and times each week. We cannot guarantee availability outwith these times. 

-24 hours notice of cancellation is required for all appointments. Failure to give appropriate notice will result in being charged the full session rate. 

-All cancellation requests must be made in writing, whether that be by email, or SMS. If the cancellation is not acknowledged within 2 hours, please contact your trainer by phone.

-If you wish to reschedule a session you have cancelled, the onus is on you to find an appointment within your trainers availability. In such cases we will try to be flexible, however we cannot guarantee a mutually suitable appointment time.

- All unused sessions expire within 90 days of purchase. 

-A session that has been cancelled and moved cannot be cancelled and moved again. In this circumstance, the client will not be offered the opportunity to move the session again and will be charged for the session.

-Notice to cancel your personal training membership must be received in writing. There is a notice period of 30 days that applies to membership cancellation. E.g. If you wish to cancel your membership in July, Notice must be given anytime before the end of May. 

-If multiple sessions have been cancelled within 24hrs, your time slot may be made available to other Train Mind Body Soul clients, and the client will no longer be entitled to that session time.

2. Group Personal Training General Terms

- Group Personal Training Sessions are carried out on the same day, time and place each week.

- If you cannot attend your scheduled group personal training session please inform your group coach as soon as possible.

- You cannot cancel / reschedule group personal training sessions.

- You will not receive a refund for any missed sessions. 

- If you miss / fail to attend a scheduled group session for any reason you understand that you will lose this session.

- Group personal training is paid for on a monthly basis for the sessions due that coming month.  

- Group personal training membership fees will continue on a monthly basis for the duration of your membership. 

- Notice to cancel your group personal training membership must be received in writing. There is a notice period of 30 days that applies to membership cancellation. E.g. If you wish to cancel your membership in July, Notice must be given anytime before the end of May.

3. Refund Policy

-Refunds are not provided under any circumstances whether sessions have yet to commence or if sessions are currently ongoing. We reserve the right to offer you a grace period in which you are able to redeem any outstanding sessions.

-Note that in the case of long term absence from training, the trainer cannot keep time slots open for you.

-If you are unable to continue training for any reason, you may transfer unexpired sessions to another suitable person.

-Any issues relating to payments including requests to transfer training to another person, and cancellation of ongoing training must be made via email to our accounts manager at (accounts@trainmbs.com)

-If your Personal Trainer is on holiday, or off sick, you can choose to continue your sessions on their return. You will be given as much notice as possible for this. Refunds will not be given on sessions that have to be rescheduled under these circumstances.

4. Appointment Policy

-Personal training sessions and group personal training sessions  are 45 minutes in duration.

-If you arrive late for a session, the session cannot be extended and will end at the appointed time.

-If you’re late for your session, your session length will be deducted accordingly, and you will be charged at the scheduled rate. If you’re more than 15 minutes late, the session may be cancelled, and you will be charged for the full session.

5. Payment Policy

-Payment for all training services must be made in advance of any training sessions taking place. Payment is to be made via recurring direct debit or card payment, which can be set up through our online store. Our payments are processed by:

  •  Stripe, integrated into our website via Squarespace ecommerce. 

  • Gocardless, providing secure direct debit payments for our personal training clients. 


6. Privacy

Our Privacy Policy forms a part of these Terms. Please review the Privacy Policy to learn about:

-What information we may collect about you;

-What we use that information for; and

-With whom we share that information.

7. Informed Consent

Our Informed Consent policy forms a part of these Terms. Please review our Informed Consent Policy to learn about:

- The objectives of our services

- The potential risks and benefits of using our services

8. Trainer's Obligations

-The trainer will use their skills and knowledge to design a safe programme of exercise to achieve the client’s goals.

-This will take into account: the client's age, health, lifestyle, background, occupation, fitness levels, likes and dislikes related to exercise and personality.

-The trainer will endeavour to educate, motivate and inspire the client to reach these goals.

-The trainer will provide coaching, supervision, advice and support that the client will need to help them achieve their goals during each session.

-The trainer will keep you informed about the progress of your training and be completely honest if goals are unattainable.

-The trainer will communicate any changes to your upcoming sessions at the earliest possible opportunity.

-To lead by example and give 100% commitment.

-To be responsible in helping you train in a safe, clean environment.  

-Keep your data safe & inform you on what data we store. Have a transparent policy about how we use your information.

9. Client's Obligations

-Be on time so that a full session can be achieved on each visit. Arrive promptly for training sessions.

-Update us of any changes to your health which would affect your ability to exercise in a safe manner.

-The client is required to wear appropriate clothing and footwear.

-Do not come in for a session if you are unwell, as this puts your trainer and our other members at risk. In the event that you have to cancel a session within 24 hours notice, the usual cancellation policy is still valid.

-Commit to the programme 100% in order to achieve results. If you are no longer fully committed to the programme we would ask that you vacate your spot, to allow someone else the opportunity to work with your trainer.

-In extremely rare circumstances, in which you are no longer committed to the programme with sufficient effort, or repeatedly not following your trainers guidance and advice, we may ask you to vacate your spot to allow another client to take advantage of training with us. 

-Provide all information required to achieve your goals eg. Food diary, lifestyle information and exercise history.

-If the trainer requires, provide further medical information from a practitioner.


10. Health & Safety Policy

-Should you experience any pain, discomfort, or injury, during any of your sessions, please inform your Personal Trainer immediately, who will ensure appropriate action is taken.

-Prior to, or during, the course of your training, health concerns may arise that may require further input from your doctor, physiotherapist, or other allied health professional. The trainer may request your assistance in obtaining that information

-Please be aware that your Personal Trainer cannot diagnose and/or prescribe treatment for any form of injury, disease, or other medical problem.

-Train Mind Body Soul will not accept liability for any damage or loss to a clients personal property brought into the studio premises, including waiting, treatment room and bathroom areas.

-All clients must conduct themselves in a respectful manner whilst using the studio facilities. Any client who acts in an intimidating, abusive, violent or disrespectful manner be asked to leave the gym.

-All clients must complete a PAR-Q before commencing any exercise programme.

-Your trainer may require a letter of 'medical clearance' from your GP depending on your health status. (Please be aware that your GP may charge for providing this letter).

-Your trainer cannot be held liable in any way for undeclared or unknown medical conditions.

-Any changes to your health must be discussed with your GP or healthcare provider. 

-It is your responsibility to inform us of these changes and fill in a new PAR-Q form when appropriate.

-The purchase of any package or product by Train Mind Body Soul Limited and our Personal Training Team, is deemed as your acceptance of these Terms & Conditions.
